01 / Definitions

"System" means the ReSystemati website at resystemati.com, its protocols, research summaries, tools and the Weekly Dispatch. "Optimizer" means any individual using the System. "Protocol" means any routine, schedule, stack or practice described on the System. "The ReSystemati Entities" means the operator of the System under the ReSystemati trade name and its authors, reviewers and contractors.

02 / Scope and Acceptance

These Terms govern use of the System. Using the System means accepting these Terms and the Privacy Policy. Optimizers must be at least 18.

03 / Protocol Risk Acknowledgement

PROTOCOLS ON THE SYSTEM CAN INCLUDE FASTING OR TIME-RESTRICTED EATING, COLD AND HEAT EXPOSURE, HIGH-INTENSITY OR ENDURANCE TRAINING, SLEEP CHANGES AND SUPPLEMENTS. THESE CARRY REAL RISKS AND ARE NOT SUITABLE FOR EVERYONE, INCLUDING PEOPLE WHO ARE PREGNANT OR NURSING, HAVE DIABETES, HEART CONDITIONS, A HISTORY OF EATING DISORDERS, OR TAKE MEDICATION. CONSULT A PHYSICIAN BEFORE STARTING ANY PROTOCOL. STOP IMMEDIATELY IF YOU FEEL UNWELL. IN AN EMERGENCY CALL 911.

The System is educational. No part of it substitutes for a clinician’s assessment, and using it creates no clinician–patient relationship. Optimizers decide for themselves whether to follow any Protocol and assume the associated risk.

04 / Research Summaries and Evidence Ratings

Research summaries and evidence ratings reflect the editors' reading of the studies cited at the time of writing. Studies may be small, preliminary, conducted in specific populations or later contradicted. A rating is an editorial judgement, not a guarantee of efficacy or safety, and citing a study is not an endorsement by its authors.

05 / Metrics, Scores and Reader Outcomes

Figures such as reader counts, self-reported improvements, adherence percentages and optimisation scores are illustrative or self-reported, are not the result of controlled studies, and do not predict results for any individual.

06 / Supplements and Products Mentioned

The System does not sell supplements. Mention of a supplement or compound is not a recommendation to take it. Supplements are not approved by the U.S. Food and Drug Administration to diagnose, treat, cure or prevent any disease.

07 / Weekly Dispatch

The Dispatch is a free email. Optimizers may unsubscribe at any time using the one-click link. The ReSystemati Entities may change its content or frequency.

08 / Licence

Subject to these Terms, Optimizers receive a personal, revocable, non-transferable licence to read the System and use Protocols for their own purposes. All content, frameworks, tables, protocol names and code are owned by or licensed to the ReSystemati Entities. Copying, republishing, commercial use, or use in training machine-learning models requires written permission.

09 / Prohibited Uses

• automated scraping, crawling or bulk download;
• security testing, probing or disruption of the System;
• presenting System content as one’s own or as clinical guidance to others;
• unlawful use or infringement of others’ rights.

10 / Disclaimers

THE SYSTEM IS PROVIDED "AS IS" AND "AS AVAILABLE." THE RESYSTEMATI ENTITIES DISCLAIM ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW, INCLUDING ACCURACY, COMPLETENESS, FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY AND NON-INFRINGEMENT, AND MAKE NO WARRANTY THAT ANY PROTOCOL WILL PRODUCE ANY RESULT.

11 / Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RESYSTEMATI ENTITIES ARE NOT LIABLE FOR ANY PERSONAL INJURY, ILLNESS OR ADVERSE HEALTH OUTCOME RESULTING FROM AN OPTIMIZER'S DECISION TO FOLLOW A PROTOCOL, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. AGGREGATE LIABILITY IS CAPPED AT ONE HUNDRED U.S. DOLLARS (US$100).

12 / Indemnity

Optimizers indemnify the ReSystemati Entities against third-party claims and related costs, including reasonable legal fees, arising from their breach of these Terms or misuse of System content.

13 / Dispute Resolution

13.1 Pre-filing notice

Before any proceeding, the claimant sends a written description of the claim and the relief sought. The parties negotiate in good faith for 45 days.

13.2 Arbitration

Unresolved claims are settled by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Consumer Minimum Standards, conducted remotely unless the arbitrator decides otherwise. Small-claims court remains available for qualifying claims.

13.3 Mass filings

Where 25 or more substantially similar demands are brought with coordinated counsel, JAMS will administer them in sequential batches of up to 25, with statutes of limitation tolled for pending demands.

13.4 Class waiver and opt-out

Only individual claims are permitted. Opt-out window: 30 days from first acceptance. Method: email to support@resystemati.com with the subject “Arbitration opt-out.”

14 / Governing Law

Governing regime: U.S. federal law. Conflict-of-laws rules: not applied. Forum for any non-arbitrable claim: a United States federal court with subject-matter and personal jurisdiction.

15 / General Provisions

Severability: an unenforceable provision is modified to the minimum extent necessary. Waiver: failure to enforce is not a waiver. Assignment: the ReSystemati Entities may assign these Terms. Survival: risk acknowledgement, licence restrictions, disclaimers, liability, indemnity and dispute provisions survive. Entire agreement: these Terms and the Privacy Policy. Changes: revised Terms take effect when posted with a new version date.
